This Trust & Safety Policy explains how Dualy detects, reviews, and enforces against content and behavior that violates our Community Standards & Acceptable Use Policy. It works alongside the Dualy Creator Terms & Conditions and Dualy Creator Code of Conduct, which govern your legal relationship with Dualy and are incorporated by reference.
1. Purpose & Scope
This Trust & Safety Policy ("Policy") describes the systems, processes, and standards Dualy LLC ("Dualy," "we," "us") uses to detect, review, and act on content and behavior that violates the Dualy Creator Terms & Conditions, the Acceptable Use Policy contained therein, and the Dualy Creator Code of Conduct (collectively, the "Platform Rules").
This Policy applies to all content and activity on Dualy, including live sessions, recorded replays, Creator profiles, Marketplace listings, direct messages, and any other feature through which a user can post, broadcast, or transact on the platform. It applies to all users, whether enrolled in the Creator Program or using Dualy's free tier.
2. Content Model: Live Sessions Are the Only Path to Publication
Dualy does not support direct upload of pre-recorded video, image, or audio content. The only way a user creates content on Dualy is by hosting or participating in a live session. Recorded replays and archived content on a Creator's profile are generated exclusively from live sessions that have already passed through the proactive moderation pipeline described in Section 3. There is no upload path, bulk-import tool, or API that allows content to reach a Creator's profile, a fan's feed, or the Marketplace without first being broadcast live and screened in real time.
This design choice is deliberate: because every piece of content Dualy hosts was, at some point, a live broadcast, every piece of content Dualy hosts has been subject to frame-level automated screening before it ever reached a viewer.
3. Proactive Moderation Pipeline
3.1 Real-Time Machine Learning Detection
Dualy applies machine learning (ML) models to actively analyze frames of every live session as it is being streamed. This screening occurs before the frame is broadcast to any viewer — detection happens ahead of, not after, publication to the audience.
3.2 Automatic Stream Termination
If the ML models detect content that appears to violate the Acceptable Use Policy (Section 9 of the Creator Terms & Conditions), Dualy immediately and automatically terminates the live stream. The session is halted before the suspected violation can reach a broader audience.
3.3 Human Moderator Escalation
Every automatic termination is escalated to a trained human moderator. The moderator reviews the flagged session, including the frames that triggered detection, and issues the final verdict: confirming the violation and applying enforcement under Section 6, or clearing the account if the detection was a false positive. Machine learning identifies and interrupts; a human being decides.
3.4 Recorded Replays Inherit Pipeline Review
Because replays and profile archives are generated only from live sessions (Section 2), any content that is saved as a replay has already been screened by the pipeline in Sections 3.1–3.3 before it was ever broadcast, and therefore before it is available to be saved.
4. Reporting & Blocking
4.1 Viewer Reporting
In addition to proactive detection, Dualy provides a viewer-facing report option available during any live session or on any saved replay. Submitting a report immediately triggers two things in parallel: (1) escalation to a human moderator for review, and (2) analysis by enhanced, more sensitive AI detection models calibrated to catch violations that the standard real-time pipeline in Section 3 may not flag at broadcast speed. Reported content is prioritized in the moderation queue over routine automated flags.
4.2 Blocking
Any user, whether a Creator or a fan, can block another user directly from within the app. Blocking is independent of reporting: a user does not need to file a report to block someone. Once blocked, the blocked user cannot view the blocking user's live sessions, replays, or profile, cannot send them messages, and cannot interact with their content. Blocking can be reversed by the blocking user at any time.
4.3 Response Time
Dualy reviews and acts on user-submitted reports of objectionable content within twenty-four (24) hours of receipt. Where a report is confirmed, action includes removal of the violating content and, consistent with the strike escalation in Section 6, restriction or ejection of the responsible user.
5. Identity Verification & Accountability
Accountability on Dualy is tied to verified identity for any user who wants to monetize. To host paid, monetized sessions, a Creator must complete mandatory identity verification (KYC) as described in Section 1.3 of the Creator Terms & Conditions, including a government-issued photo ID and a live selfie or video check. Free-tier users who do not enable monetization are not required to complete ID verification to use the platform, but are equally subject to this Policy, the Acceptable Use Policy, and the enforcement measures in Section 6.
This distinction matters for enforcement: because monetized access is tied to a verified identity, a permanent ban of a paid Creator account under Section 6 extends to the underlying identity on file, not merely the account credentials — see Section 6.3.
6. Enforcement: Strike Escalation
Confirmed violations of the Acceptable Use Policy are enforced through a graduated strike system, applied on a rolling basis per verified identity (for Creators) or per account (for free-tier users).
| Strike | Trigger | Consequence |
|---|---|---|
| 1st violation | First confirmed AUP violation | Formal warning issued. Account is placed on a high-scrutiny list for enhanced proactive review. |
| 2nd violation | Second consecutive confirmed violation | Temporary restriction for seven (7) days. Account cannot host live sessions or, if applicable, receive payouts during the restriction. |
| 3rd violation | Third confirmed violation | Permanent removal. Free-tier accounts are permanently banned. Paid Creator accounts are permanently banned together with the underlying verified identity (Section 6.3). |
6.1 Severe Violations Bypass Escalation
Dualy may bypass the strike ladder in Section 6 and proceed directly to temporary suspension or permanent removal for severe violations — including any violation involving a minor, a credible threat of violence, or other conduct warranting immediate action — regardless of the account's prior strike history.
6.2 High-Scrutiny List
Accounts placed on the high-scrutiny list following a first violation receive more frequent proactive review for the duration of their participation in the Creator Program, or until removed from the list at Dualy's discretion following a sustained period without further violations.
6.3 Identity-Level Bans for Paid Creators
Where a paid Creator account is permanently banned under a third violation, the ban attaches to the verified identity on file under Section 1.3 of the Creator Terms & Conditions, not solely to the account. This is intended to prevent a banned Creator from re-enrolling a new paid account using the same government-issued identification.
7. Appeals
A user who receives a warning, temporary restriction, or permanent removal may appeal the decision through the in-app appeals process within a reasonable period of the enforcement action (currently 14 days). Appeals are reviewed by a human moderator who was not involved in the original decision. Decisions involving confirmed harm to a minor, terrorism, or credible threats of violence are not eligible for appeal.
8. Zero Tolerance for Minor Safety
Dualy applies zero tolerance to any content or activity that sexualizes, endangers, or otherwise exploits a minor. Any suspected violation involving a minor bypasses the standard escalation path entirely: the account is suspended immediately pending investigation, and Dualy will preserve relevant records and refer the matter to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement as required by law, regardless of the user's account status, tier, or prior history.
9. Record Retention & Law Enforcement Cooperation
Dualy retains session recordings, moderation decisions, and associated metadata for flagged and reported content for a period sufficient to support investigation, appeals, and legal compliance: currently ninety (90) days for reports that are reviewed and not actioned, and two (2) years for confirmed Acceptable Use Policy violations (including the enforcement history relied upon for the strike escalation in Section 6), in each case subject to extension under legal hold where applicable. Dualy cooperates with law enforcement requests consistent with its Privacy Policy and applicable law, and may proactively refer matters involving imminent harm, terrorism, or child exploitation without a prior request.
Where content is reported to the National Center for Missing & Exploited Children (NCMEC) CyberTipline under Section 8, Dualy preserves the reported content and associated data for a minimum of one (1) year following submission, consistent with 18 U.S.C. § 2258A(h) as amended by the REPORT Act of 2024, and may preserve it longer where necessary to support an active investigation or legal process.
10. Governance & Roles
10.1 Trust & Safety Team
Dualy maintains a dedicated Trust & Safety function responsible for setting moderation policy, tuning detection models, training human moderators, and overseeing the appeals process.
10.2 Human Moderators
Human moderators are trained on the Platform Rules and this Policy and are the final decision-makers on any automatically flagged or user-reported session. Moderators document the basis for each decision in the moderation system of record.
10.3 Continuous Improvement
Dualy's engineering team continuously evaluates and improves the accuracy of the detection models referenced in Sections 3 and 4 to reduce both missed violations and mistaken enforcement actions.
11. Transparency
Dualy may publish periodic transparency reporting summarizing enforcement volume, categories of violation, and appeal outcomes, in a manner that does not compromise the safety, privacy, or effectiveness of the moderation systems described in this Policy.
12. Relationship to Other Documents
This Policy works together with, and does not replace, the Dualy Creator Terms & Conditions (including Section 9, Community Standards & Acceptable Use Policy, and Section 10, Suspensions) and the Dualy Creator Code of Conduct. Where this Policy describes an operational mechanism and the Creator Terms & Conditions or Code of Conduct state a contractual rule, the contractual document governs the legal relationship between Dualy and the user; this Policy governs how that rule is detected and enforced in practice. Dualy may update this Policy from time to time to reflect changes to its moderation systems, consistent with the modification provisions of the Creator Terms & Conditions.
